Terms of Service

These Terms of Service ("Terms") govern your access to and use of the NovOrcam mobile application, related software, websites, services, features, and content (collectively, the "Service"), operated by VALC Apps ("VALC Apps," "NovOrcam," "we," "us," or "our").

By downloading, installing, accessing, subscribing to, or using NovOrcam, you acknowledge that you have read, understood, and agree to be legally bound by these Terms. If you do not agree to these Terms, you must not use the Service.

1. Eligibility and Acceptance

You represent that you are legally capable of entering into these Terms under applicable law. If you use the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

2. Description of the Service

NovOrcam provides tools that may allow users to create, configure, record, manage, schedule, and execute user-controlled automation workflows on compatible Android devices. Depending on the version and features available to you, the Service may include macro recording and playback, accessibility-based automation, configurable actions, timing controls, scheduled tasks, image-related detection or imported targets, and other automation features.

The Service may also include screen-snipping and manual SELECT AREA tools used to define precise regions of the screen for local image detection or OCR processing. These tools are user-directed and are intended to process only the area selected by the user.

NovOrcam may also provide optional Run Logs / Diagnostics for reviewing automation execution. Run Logs may record local technical events such as run status, step execution, timing, detection-state transitions, and other diagnostic information depending on the selected logging detail.

Features may change, be added, restricted, discontinued, or made available only to certain users or subscription tiers without prior notice where permitted by applicable law.

3. Accessibility Service and Device Permissions

Certain NovOrcam features may require Android Accessibility Service functionality or other device permissions. You voluntarily decide whether to enable these features and permissions.

You understand that accessibility-based automation may interact with elements displayed on your device according to the automation instructions you configure. You are responsible for reviewing Android's permission disclosures and ensuring that you understand the permissions you enable.

You must not use NovOrcam to circumvent Android security controls, obtain unauthorized access to another person's device or account, intercept private communications, or perform any activity that violates applicable law or the rights of others.

4. Your Responsibility for Automation

NovOrcam does not independently decide which applications, services, accounts, screens, targets, actions, or workflows you automate. Automation is initiated and configured by the user.

You are solely responsible for:

• every macro, automation sequence, scheduled task, setting, target, action, or configuration you create or run;
• verifying that your automation behaves as intended before relying on it;
• supervising automation where supervision is appropriate;
• maintaining backups of important information before using automation;
• ensuring that your use complies with applicable laws, platform rules, contracts, and third-party terms; and
• selecting appropriate screen regions when using screen-snipping, Image, or OCR SELECT AREA features, including avoiding unauthorized or unnecessarily sensitive content;
• reviewing exported or shared Run Logs before disclosure, because diagnostic logs may contain details about your automation configuration or execution context; and
• any consequences resulting from automation that you configure, authorize, trigger, or fail to stop.

6. Third-Party Applications, Games, Websites, and Services

NovOrcam is an independent application. Unless expressly stated otherwise, VALC Apps is not affiliated with, sponsored by, endorsed by, or approved by any third-party application, game, website, platform, service, publisher, or account provider that may be used with NovOrcam.

Third-party services may prohibit automation, macros, auto-clicking, accessibility-based interaction, repeated input, or similar activity. You are solely responsible for reviewing and complying with the applicable rules of any third-party service you choose to use.

7. No Guarantee of Compatibility or Results

Android devices, operating system versions, manufacturers, accessibility implementations, screen layouts, third-party applications, and services may change at any time. Accordingly, we do not guarantee that NovOrcam will work with every device, Android version, application, game, website, account, feature, or operating environment.

We do not guarantee uninterrupted operation, error-free performance, successful execution of any automation, preservation of user data, compatibility with future software updates, or any particular result from using the Service.

8. User Content, Macros, Configurations, and Data

You retain responsibility for macros, configurations, schedules, imported materials, targets, and other content that you create, configure, import, store, or use through the Service.

You represent that you have the necessary rights and permissions to use any material you import or configure with NovOrcam. You must not use copyrighted, confidential, private, or proprietary material in a manner that infringes the rights of another person or entity.

9. Purchases, PRO Features, and Subscriptions

NovOrcam may offer paid features, subscriptions, or other purchases, including recurring PRO access. Where a purchase is made through Google Play, payment processing, subscription management, billing, cancellation, renewal, and refund procedures are generally subject to the applicable Google Play terms and policies in addition to these Terms.

Subscription prices, billing periods, available plans, and features may be displayed to you before purchase and may change for future purchases or renewals where permitted by applicable law and platform rules.

Unless otherwise stated at the time of purchase, recurring subscriptions may renew automatically until canceled through the applicable Google Play account or subscription management interface. Deleting or uninstalling the application does not necessarily cancel an active subscription.

We do not guarantee uninterrupted access to paid features in circumstances outside our reasonable control, including platform outages, device incompatibility, account issues, payment failures, Google Play service interruptions, or enforcement actions required by law or platform policy.

10. Refunds and Billing Disputes

Purchases made through Google Play may be subject to Google Play's applicable refund policies and procedures. VALC Apps does not control Google Play's final decisions regarding payment processing or refunds where Google Play is the merchant or billing platform.

You should not initiate fraudulent chargebacks or payment disputes. Where permitted by applicable law, fraudulent or abusive payment activity may result in suspension or termination of access to paid features.

11. License to Use the Service

Subject to these Terms, VALC Apps grants you a limited, personal, non-exclusive, non-transferable, non-sublicensable, revocable license to use NovOrcam for lawful purposes on compatible devices.

No ownership rights are transferred to you. The Service, including its software, design, branding, code, features, and other proprietary materials, remains owned by VALC Apps or its licensors.

12. Intellectual Property

NovOrcam, VALC Apps, associated branding, logos, software, user interfaces, text, graphics, and other Service materials are protected by applicable intellectual property laws. You may not copy, sell, lease, distribute, reproduce, publicly display, exploit, or create derivative works from protected materials except as expressly permitted by law or by written authorization from VALC Apps.

13. Security and Unauthorized Modification

You must not attempt to disable, defeat, bypass, manipulate, or interfere with reasonable security, licensing, subscription, entitlement, verification, or anti-tampering mechanisms used by the Service.

Unauthorized modification or redistribution of the application may result in termination of access and any other action available under applicable law.

14. Updates and Changes

We may update, modify, suspend, remove, or discontinue any part of NovOrcam at any time. Updates may be necessary to address security, compatibility, legal, technical, or operational issues.

You acknowledge that future Android, device manufacturer, Google Play, or third-party software changes may affect the availability or functionality of NovOrcam.

15. Suspension and Termination

We may suspend or terminate access to the Service or certain features, where reasonably necessary and permitted by applicable law, if we believe that you have violated these Terms, used the Service unlawfully, attempted to compromise the Service, engaged in fraud or abuse, or created a security or legal risk.

You may stop using NovOrcam at any time. Termination of use does not automatically cancel obligations that, by their nature, survive termination, including intellectual property protections, disclaimers, limitations of liability, and indemnification obligations.

16. Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. VALC APPS DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, AVAILABILITY, SECURITY, AND UNINTERRUPTED OR ERROR-FREE OPERATION.

Nothing in these Terms excludes or limits any warranty or consumer right that cannot lawfully be excluded or limited.

17. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, VALC APPS, ITS OWNERS, DEVELOPERS, CONTRIBUTORS, AFFILIATES, AND SERVICE PROVIDERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF DATA, PROFITS, REVENUE, BUSINESS, GOODWILL, ACCOUNTS, ACCESS, DIGITAL ITEMS, VIRTUAL PROPERTY, OR OTHER LOSSES ARISING OUT OF OR RELATING TO YOUR USE OF, INABILITY TO USE, OR MISUSE OF THE SERVICE.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THIS INCLUDES LOSSES OR CONSEQUENCES ARISING FROM USER-CONFIGURED AUTOMATION, THIRD-PARTY ACCOUNT ACTIONS, DEVICE MALFUNCTION, SOFTWARE CONFLICTS, COMPATIBILITY ISSUES, FAILED OR UNINTENDED AUTOMATION, SERVICE INTERRUPTIONS, OR THIRD-PARTY POLICY ENFORCEMENT.

TO THE EXTENT LIABILITY CANNOT BE EXCLUDED UNDER APPLICABLE LAW, VALC APPS' TOTAL AGGREGATE LIABILITY ARISING FROM OR RELATING TO THE SERVICE SHALL BE LIMITED TO THE AMOUNT YOU ACTUALLY PAID TO VALC APPS FOR THE SPECIFIC SERVICE GIVING RISE TO THE CLAIM DURING THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR THE MINIMUM AMOUNT REQUIRED BY APPLICABLE LAW, WHICHEVER IS GREATER.

18. Indemnification

To the maximum extent permitted by applicable law, you agree to defend, indemnify, and hold harmless VALC Apps and its owners, developers, contributors, affiliates, and service providers from and against claims, liabilities, damages, losses, costs, and reasonable expenses arising from or relating to:

• your violation of these Terms;
• your unlawful or unauthorized use of NovOrcam;
• automation, macros, or configurations created or executed by you;
• your violation of a third party's terms, policies, rights, or applicable law; or
• your misuse of the Service.

19. Assumption of Risk

You acknowledge that automation can produce unintended results if incorrectly configured, used in an incompatible environment, affected by software updates, or left running without appropriate supervision. You voluntarily assume the ordinary and foreseeable risks associated with using user-configured automation, to the maximum extent permitted by applicable law.

20. Privacy

Privacy and information handling for the Service are described in the NovOrcam Privacy Policy. In particular, screen-snipping, selected Image/OCR regions, screenshots, OCR text, user-created automation content, and optional Run Logs are intended to be processed and stored locally except for limited information handled by disclosed third-party services for functions such as analytics, crash reporting, advertising, purchase verification, or security.

Users should not export or share diagnostic logs, screenshots, OCR output, or other automation-related content unless they are authorized to disclose that information.

Your use of the Service is also subject to our Privacy Policy. Please review the Privacy Policy to understand information practices associated with the Service.

21. Changes to These Terms

We may revise these Terms from time to time. The updated version will be posted on our website with a revised "Last Updated" date. Your continued use of NovOrcam after updated Terms become effective constitutes acceptance of the updated Terms, except where applicable law requires additional notice or consent.

22. Severability

If any provision of these Terms is determined to be invalid, illegal, or unenforceable, that provision shall be enforced to the maximum extent permitted by law, and the remaining provisions shall remain in full force and effect.

23. No Waiver

A failure or delay by VALC Apps to enforce any provision of these Terms shall not constitute a waiver of that provision or any other right.

24. Governing Law and Venue

These Terms shall be governed by and interpreted in accordance with the laws applicable to VALC Apps and the Service, without regard to conflict-of-law principles, except where mandatory consumer protection laws provide otherwise.

Where legally permitted, disputes arising from these Terms or the Service shall be brought before the courts or other competent authorities having jurisdiction over the matter.

25. Consumer Rights

Nothing in these Terms is intended to remove, waive, or limit consumer rights that cannot legally be waived or limited under applicable law. Where mandatory law conflicts with a provision of these Terms, the mandatory law shall apply to the extent required.
